He probably didn't have enough Paragon or Renegade.
How people manage to do this, I don't even know. The game literally hands you reputation just for breathing.
Could have been another reason:
Requirements1) Played and imported your save game from ME2
2) Both Legion and Tali must have survived from ME2 and have been loyal.
3) Tali cannot have been exiled or she will not have the authority to help you get the choice you want when it comes time.
4) You must have saved the Admiral on the bonus mission you go to
destroy the reaper base on Rannoch. He will back your decision later
when you push for peace, if he's dead because you didn't save him, that
will be problematic as you might guess.
5) You must have enough Paragon and Reputation to unlock the choices even after meeting the other requirements.
6) When the time comes side with Tali and when Legion pleads with you to
reconsider, you will have a Paragon option to save both sides or a
Renegade option to Give the Fleet a heads up about Legion's plan. No
matter what happens Legion will always die. But part of his program now
lives in every non-enslaved Geth.
