Even if Garrus (along with the rest of the squadies) can't be there for the trial, there's no good reason for them not to be watching. Since the trial is very likely a crapshoot public stunt to appease the batarians, I think it's possible that the trial would have a live broadcast throughout the galaxy. In that case, I think it'd be cool to have cinematic cuts to squadmates during the trial -for example, someone is giving testimony when suddenly the camera cuts to Mordin, busily working while the broadcast plays in the background - or Garrus, who snarls quietly into his omni-tool in response to a harsh bit of testimony. Just short, several-second cameos that sets up some world-building for new players while rewarding the returning ones.
The only problem with this theory is that military trials are very rarely given public promotion. But I spoke with my father (formerly US Air Force) and he told me that a military trial involving a former soldier might get a pass since they're technically a citizen, though circumstances would have to be special - the person being of importance and on trial for terrorist activities, for example. I was very specific with my questions

There are 2 big theories on the trial
a) Its gonna be a military trial, court-martial style. Shepard will be put on the sand and might very well reveal sensitive military informations or ask why the Alliance didnt do this and that. No way is it gonna be public and they certainly wont let your pet aliens and cerberus friends in.
So ya thats 2 completely diffrerent vibes. What will Garrus be doing?
First idea is that hes gonna go back to Palaven help his family/homeworld prepare. Or maybe if he feels helping somewhere else will save more ppl (someone proposed helping the Krogans a few days ago) he might go elsewhere. Hes renegade enough to pull that kind of logic.

Yeah, Jacob...doesn't really make a whole lot of sense there. Then again, racist comments rarely do.
I'm guessing he's referencing Garrus' exoskeleton, with an added reference to birds, seeing as how turians are sometimes described as having avian characteristics.

Emily Wong and the other reporter (the one you get to punch a couple times) will be there to harass you and make you look bad. Your dedicated crew will probably have better things to do to stop the Reaper arrival then watch you get chewed on screen or wave at you in the trial room.
The thing is, the entire Arrival mission was supposed to be top secret. Publicising the trial would then also mean publicising the fact that the Alliance sent in a sneak mission into batarian space to retrieve ONE person who was engaged in dubiously legal activities anyway. Not sure public opinion would necessarily be on the side of the Alliance when details get out. And I'm pretty sure they don't need widespread panic/public outrage when they're trying to avoid a war on two fronts.
Which is why I think option a) is more likely.
