MS have stated several times that they wont ban legitimate players who get a game early. Most likely those that got banned where pirates.

LOL. That almost happened to me with ARMA2. Right after moving a couple months ago I noticed that all of a sudden ARMA2 had developed some graphical glitches, and my FPS had deteriorated. I thought of everything that could possibly have gone wrong in a move, and I was thinking maybe something had just loosened up or my HDD had gotten bounced too hard maybe. If you were correct, why wouldnt they have banned all the people who had Halo ODST early? There was about 5,000 people who had early copppies. Yet, they repeatedly say " We will not ban people who played it early, only pirated versions". As you said, thats Microsoft.
What can Bioware do to a person who gets the game early? Not alot legally. Since Person X has never signed or agree'd to any legal terms.. There's not much they can do. If there was no contract for "Do not sell before X day", Then even the store is in its rights. That little sticker that says Do not sell before X day is more of a recommendation. It would be a waste of time and money for Bioware and/or EA to even go after anyone for doing this, Unless they signed a contract with stores for the release date. In which case only the stores would be in trouble. What I said about buying things early is 100% accurate.
Forgot to say. Bioware and/or EA probably doesn't even care if 10-50 people get the game early(No, im not talking for Bioware, just speculating). If the game was bought legally, Aren't they still getting their money? Lets say Wal-Mart sells it early, Well everyone will that area will rush into that store and buy it up. Poor little Game-Stop loses all its business. My point is, the Street date is more or less for fairness among game sellers.
Plus, They guy posted on their website asking if it was ok to play early. Have any of the Devs said no? Could Xbox ban him? Sure, they would if he they felt it obtained it unlawfully.

Some character interactions are better than others. So far the one I like is the dog. Very loyal and very useful in combat.
