Will Shepard's Past Influence the Trial? ***SPOILERS AHOY!!!***

I just thought of something today - three of Shepard's possible backstory aspects entail the Batarians. There's the fact that everyone (s)he knew was killed by Batarians if Shep is a Colonist or that (s)he killed a bunch if Shep is either Ruthless of a War Hero. Does anyone think that these highlights in Shepard's past might be used by the Batarian prosecuting attorney (or equivalent thereof) as evidence that would suggest that Shepard had neglected to warn the Batarians when the mass relay was going to be destroyed as the result of a deliberate prejudice against the Batarians?

It is entirely possible that your chosen back-story will be mentioned at the trial, but the likeliness of it actually counting against you in a game-mechanics manner is low. I can't see BioWare making the trial more difficult because of your back-story. However, the Trial itself may never reach a verdict b/c of the Reaper invasion, so it may just serve as a way to introduce new players to Shepard and remind returning players of what they chose on this particular character.

Shepard isn't prosecuted persay. The Alliance is in charge of the case and I doubt they'd allow a Batarian attorney or a Batarian simpathizer even set foot in the sol system. It's just a formality to clear things up and get info on Cerberus. Otherwise Shepard wouldn't have let them get they're hands on the Normandy.

Shepard could have let the Normandy hidden and used the shuttle. Shepard isn't at risk of ending up in jail, the Alliance know how valuable he is, Spectre or no.

Probably at the moment the verdict is rendered the Reapers will begin their attack and everybody will be OH ****, SHEPARD WAS RIGHT, RUNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNNN!

Not as evidence. The most I can see out of the combinations of pre-service histories and psychological profiles directly influencing the 'trial' is the accusers showing Shepard had motive (or lack thereof) should Shepard deny involvement or knowledge of the event. The most obvious being colonist/ruthless, colonist/sole survivor, or earthborn/ruthless. The only combination that I can see being a difficulty for the accusers to try to establish a motive would be spacer/war hero or earthborn/war hero.
