Shepard is a Marine.
It is incorrect to state that Shepard ceased being a Marine the moment he became a Spectre. There is not single scene in any playthrough where Shepard resigns his Commission. Even after being made a Spectre, he continued to command an Alliance warship and it's Alliance crew, is referred to troughout the game as Commander Shepard (Lt. Commander being a rank in the Alliance Navy/Marines), and refers to himself as Commander Shepard. Depending your dialogue choices he also frequently observes military customs & courtesies, such as standing at parade rest or saluting a superior officer. We also know that he's still in the Alliance at the start of ME3, since he goes back to commanding an Alliance warship.
Being a Spectre and an Alliance Marine are not mutually exclusive. To use a real world example, during the Second World War some American OSS (Office of Strategic Services) and and British MI6 agents that were parachuted into German occupied Europe as spies and saboteurs were also members of their respective countries' Armed Forces. The wartime head of the OSS, William 'Wild Bill' Donovan, was also a career Army officer. They didn't cease to also be military personnel the moment they were recruited by a civilian intelligence service. One of the most decorated OSS agents of the Second World War, Peter Julien Ortiz, was also a Major in the United States Marine Corps.
Shepard is both a Spectre and an Alliance Marine.
