Nope. Property of the Alliance. Seized Cerberus ship is now an Alliance asset. Shepard never owned it anyway. If the Illusive Man wants his ship back, he can try and take it. Shepard is a disgraced rogue agent, which is sad, because before he faked his death to join Cerberus, he was a bonafide war hero. It's a shame, it really is.

Shepard was probably already being considered for promotion when he got blown up. Although as JayHart pointed out, it's difficult to promote dead people.

Plus he's referred to as Commander Shepard so often that it would be weird to start calling him Captain Shepard.

Speaking about promotion what rank does doctor Chakwas hold if she gets reinstated?
If I remember correctly military personnel can rank quite high in the army if all WW2 movies and MASH have any grain of truth to it.
So it may very well be that she'd outrank both Kaidan and Shepard by now if she got promoted along with her reassignment to Mars.

Wrex's gun whirls to face Tali as she enters. Shepard's eyes widen. Shepard dives out of cover. Time slows. The muzzle of Wrex's assault rifle flashes, but there is no sound, there is no air. Shepard dives through the air like a bird. Tali raises an arm, as if to deflect the onslaught...

But there was no need. Shepard, gasping, lies dying on the floor of the cargo hold. Tali rushes over and kneels before Shepard.

Tali, with obvious regret: "Why Shepard? What happened?"
Shepard, sputtering blood, gazing into Tali's helmet, searchingly: "I was a douche to Kaidan, I killed him Tali, I ki..."

Tali casually draws her shotgun and shoots Wrex dead.

You can't steal something and then say it's yours and expect people to respect that. Especially if the person you stole it from isn't dead.

Regardless, Shep is not taking orders from Kaidan. It's not happening. They'll figure it out or something.

Shep could either take back the Normandy, Kaidan may just defer to Shep, or Shep may be promoted. I'm sure there's other scenarios as well.

I don't think it's going to be a huge issue, really. Or at least, I'm hoping not.

It won't be a big issue. There is no evidence Shep and crew will be functioning under an alliance chain of command. In fact if they wanted to unite the various races of the galaxy, it would be better that they didn't.

But even that is missing the point. We know Shepard gets back control of the ship with or without the alliances approval.

Right. And the second Shepard is on that ship he'll liberate it from the alliance.  And Shep's not on lockup by the time he gets back to the ship. Shep's not staying in lockup for very long. Especially not allied with Cerberus. 

Also with the amount of Cerberus spies in the alliance the thought that they can't get the ship back is laughable.  

But still if Kaidan wants to deal with the Reapers on his own my Shep welcomes him to it.He'll go to a nice tropical abandoned planet and have some drinks.

This further illustrates the whole rank debacle. 

Chakwas and Joker both left the Alliance.  They are tied to a terrorist organization (which is how Alliance has pretty much classified Cerebrus).  How would they get anywhere near the Normandy in ME3, if not as civilians and only if the Alliance brass is feeling especially magnanimous?  Moreover, would the Alliance reinstate them, especially in their former rank or with promotion?  Not to bring too much real world stuff into it, but it would be like letting a ranking member of Hezbollah into the IDF as a commissioned officer.

Back to the main topic, here's a question: How common is it for someone to be promoted two full ranks in two years?  It seems making Kaidan a Staff Lieutenant is a major issue that a) wasn't completely thought through when making 2; was misunderstood and shoehorned into 2 to sound "cool".  Alternately, it was something done deliberately in 2 just to toy with us...but that's too Mordin-thinking.  It's reasonable to assume a promotion after the Battle of the Citadel, but then another in a short time period?  And becoming a Spectre on top of it?  If promitions are merit-based (as opposed to plot folly), then maybe Shepard should take orders from him (I suspected Kaidan was more intelligent than Shepard, doubly-so for renegade Shep).

As for whoever suggested demoting Kaidan (sorry, can't be arsed to look for the post) - on what grounds, plot convenience?  Maybe a court-martial for mutiny and possibly fraternization, but would that strip a rank?  Perhaps for an epic caulk-up sometime between 2 and 3, but Shepard did pull his/her own epic flamingo-up (like a c***-up, but bigger-Holly).

This conversation is so messed up because the game is so messed up. First, which country is the in game ranking system based off, if any? Probably none in particular, but it at least in the English version seems based off US rankings. If that's the case, its all messed up.

1) Kaidan is dead
2) Its impossible for an officer to receive two promotions in just 2 years
3) Shep's rankings correspond with the Navy. Additionally, his position in charge of a vessel hints to this as well (there hasn't been a Marine ship commander in the US mil since war of 1812). His progression would be Lt. Commander -> Commander -> Captain -> Rear Admiral.
4) Ashley's ranking corresponds to Marines. She would have been an enlisted in ME1 (Gunny) and then had to have finished her degree and gotten commissioned in the 2 years between games. This would put her at O-1 (2nd Lt). She is not even close to Shep in rank
5) Kaidan is all out of wack. For starters, he's an Alliance Systems Marine, like Ashley. His ranking would not be in the same line as Shep. That is the first mistake. But since they gave him the same progression in canon, there is also no such rank as Staff Commander. There's no such rank as Staff Lt either for that matter (ME1). That is mistake #2. As a marine, he would not command a ship at all (see above).
6) As I said, there are no ranks of Staff Commander or Lt. Staff XXXX is a position of specialty. These are things such as the Medical Corp or Chaplains. These individuals can gain rank and command over their specialty. However, they would never assume mission command over a combat officer. Kaidan could fall under this designation I suppose, Biotic Corp being a subset. But given his position as sentinel he could just as easily lump into Medical Corp. Either way, he wouldn't be commanding a ship.

Hmmm, I think even Dead Kaidan outranks Prisoner Shepard, the former Alliance hero turned Cerberus lackey.

Furthermore, Shep retains his rank even through death. According to military custom once and officer always an officer. Rank is retained both in retirement and death.
