he is a spectre as well, I dont think they will promote shepard after just being court marshalled though. The guy is lucky to be back in the alliance at all really.. Probably the work of admiral hackett there. But he only commands the 5th fleet.. not the alliance, then again most of the alliance politicians and navy for that matter are probably dead since arcturus station is most likely destroyed by me3 considering you have to go by it to get to earth

It's a stupid canon explanation. Commander is a rank. Captain is a title (as well as a rank), a title he earned the second he relieved Anderson of command of the Normandy SR-1.
There's a reason I called the thread "Silly demands and nitpicking" though.

That...doesnt make sense. Hundreds of human lives are at stake, as well as the entire fleet. Hackett's fleet. Shepard was a Spectre and thus his authority derived from the Citadel Council, which has no direct authority over the Systems Alliance military. If chain of command still applied, with Shepard as Commander...there would have been absolutely no way he could have made the call to sacrifice human lives/ships.
As I said. Shepard supercedes military rank.

Lucky for him the Alliance has bigger concerns right now though.. plus most of them are most likely dead

It might depending on circumstances be possible that Kaidan would technically be in command until you reach the Citadel and the council just like Captain Anderson was in the first game.
Also if I remember correctly isn't admiral Hackett stationed on the Citadel, if so it's possible that he might also reinstate Shepard or field promote him to captain after the tutorial.

Shepard is a Lieutenant Commander.
Kaidan is identified as a Staff Commander by Captain Anderson during a chat on the Citadel in ME2.
As was said earlier, Kaidan has "outranked" Shepard since then.
Not that it matters, because Spectres are outside the Systems Alliance chain of command.
