Well, it was justified in ME1 that since it was funded by the Council, and co-developed by the Turians, it could be diverted from Alliance command and enter Spectre usage. The only issue would be the Alliance crew, but it would stand to reason that if the Council requested a deferment of command in any sort of capacity, it would happen without too much fuss.

Since it was a millitary offence subject to millitary law, Shepard would be getting Court Marshalled. TIM and Captain / Councillor Anderson refer to Kaidan in ME2 as Staff Commander.. So he already outranks shepard in ME2 since Shepard is a Lieutenant Commander.

Unless he is renegade, then he promoted to "scourge of the dark beyond", which in itself is impressive and makes the reapers crap dark matter and flee to a galaxy far far away. Heard the imperium was running short of Imperial class Star Destroyers anyway.

Also, Commander is as iconic a name as Shepard. To Command is effectively to guide or lead, which is similar to the meaning of Shepard.

Unless you let the council die in ME1. Then the Alliance pretty much controls the council as well so idk what will happen there.
Regarding the crew though, just read a previous post that covered that. EDI was able to replace the entire crew and cover their duties after they were taken in ME2 so all we need is EDI who luckily is still installed on the normandy =D

A Tribunal is a group of Military officers acting as Judges and Jurors, they hear arguments and evidence then sentance the individual in question. A Court-Martial is more like a western civilian court, where there is a judge, a defense advocate and a prosecutor, as well as a panel of officers acting as jury.

Well shepards rank is called Lieutenant-Commander.. whereas Kaidan if he isn't Captain / Major by ME3 will be Staff-Commander and would probably also be adressed as just Commander.

Yes, it has been reclaimed and reworked by the Alliance, but mitigating circumstances (such as a Reaper invasion) could easily mean that placing to Spectres in command and letting them do what they can while everyone else fights would be for the best. As impressive as the Normandy is... it's still only a frigate, and the stealth systems have been proven to be beaten.

Yeah i think it was the Earth gameplay demo they mention it.. the one where Shepard and Anderson are trying to escape.. Not mentioned in the actual game but in Biowares demonstration, according
to the wiki where its mentioned as well its also in the may issue of
gameinformer.
