She is about to get tried on Earth for the death of 300,000 people with only her words as defence as no one is going to believe the Reaper story (until they appear). Its clear at best she would get a court-martial. Worst put in prison (or both).
Theres not really any justification for a promotion in the current situation. I think she's still lucky to have the rank of Commander when the Reapers do arrive!!

Shepard is iconic, and for maketing icons tend to be very important...
He/she has been marked as Commander Shepard, and thus that's what he/she will be referred to in game, it helps with the buyers...
Given this it's unlikely he'll become captain or something further up in game (maybe at the end of the game as reward for saving the galaxy, but not before), however promoting him/her to Staff Commander will make everyone happy: he/she stays Commander and gets the promotion...
After all even now it's not like they call him/her Lieutenant Commander Shepard, they just call him/her Commander Shepard...
It doesn't even have to be stressed to much, it may be mentioned once he/she is now Staff Commander (maybe some congrats will fly) and then everyone keeps calling him/her Commander...
Here's something I made some time ago with this in mind... Never used it not to unbalance my perfectly

It's not perfect or fancy, but it's something...

They are not pointless. Im not sure how your jumping to that conclusion. As I pointed out she is "Commander Shepard" its her title and image. Its not a pointless rank and Bioware have been clever with it. She can command a vessel with that rank and a crew. If shes still in command of the Normandy then having the rank of Captain is irrelevant. Can she command a fleet with the Captain title in the military, No. So its a pointless promotion in gaming terms. You cant do anything extra with the rank and you are still doing exactly the same stuff you had been doing. It adds nothing to the game. If you got promoted somehow to Admiral then it would impact the game as you can now command fleets.

As you pointed out Shepard does things above his/her rank which is understandable in ME1 but it does make his/her rank redundent and if he/she does the same in ME3 then it really doesn't matter what his/her rank is.
Anyway they will most probably not change it as there won't be a situation that would call for his/her rank to be higher as you've said which is disappointing....

It's likely Commander Shepard just stuck with everyone and nobody sees the point of changing it.
