Then legally, every creative endeavor caught in development hell was a "lie".
Including, I guess, the Mass Effect film!
And here's the difference. Media that have been caught in development, or will never see the light of day, usually have news about its cancellation, or news surrounding the halt in its development. But if something that has been announced and is wholeheartedly believed to be done, but isn't done and hasn't received any news surrounding it; while people are still waiting for it to happen can be called a lie. Deception is not caught in development; it's not going to happen. Fans were told corrections were going to be made, and they were never made or will never be made. There has been no news regarding it, not even speculation. They said they would do it, but just let the matter fade. Would it have been so hard to come out and say they cancelled their plans for Deception? Instead they promised corrections and they never happened.
As for ME the movie, there has been at least a bit of recent speculation surrounding it. Even Legendary CEO Thomas Tull have discussed how he feels about making the ME movie.
