There is a difference between the two.  Photographs or videos don't make a sex act porn.  Porn is meant purely to titilate (go ahead and chuckle) with questionable artistic value.  Porn sometimes has an element of exploitation.  Though they're not purely pornographic in that no sex takes place, the stripper asari in Afterlife and Chora's Den are certainly lewd.  And the scenes in ME1, while being explicit in what goes on while NOT being explicit in what's shown, is not porn either.  If you threw in a tasteful scene of Shep & LI, then that really isn't pornographic, even if there is side butt.

Unfortunately, there are some elements of society (*cough* fundies *cough*) that want to claim all depictions of human sexuality are prurient, no matter how natural the act, nor in what context.
