Well, he's one of my favourite characters in the Mass Effect universe, so this is a tough choice. Normally I would kill any person who has crossed me, but I'm a little biased when it comes to TIM. I can't make the decision until I confront him. I hope he hasn't betrayed Shepard so I can get him on my side. Having TIM in my squad would be the best thing ever.
What can I say, I like the guy.
I pray to Jubileus that he'll be a temporary squadmate at some point. That would make up for having to kill Cerberus troops in the game.

It would be rather awesome to see him pull out a pistol and unleash badassitude on some poor bastard.
And give them this look.

It's pretty amusing to see the bleeding hearts lash out against TIM's organization like they have the moral high ground while their Shepards work for a brutal secret police force (which puts real life ones like the gestapo and stasi to shame) of an alien racial caste good ol' boys club like the council.
Hypocrites the whole lot of them!
First time I heard the description of the Spectres in ME1, and getting to know the council a bit more that's how I began to view them. Having that kind of power will go to people's heads who think they can impose their morals on everyone else, paragon or renegade.

@DJRackham:
How, then, did he manage to not become a Husk in 30 years? Possibly there is some Reaper tech in him, but I don't think he's indoctrinated. That's all but confirmed by Mac Walters' interview, btw..
Huskification is NOT indoctronation. Two different processes are involved. Becoming a husk involves getting impaled on Dragon's Teeth. Indoctrination is initiated by simply being in close proximity to a Reaper or Reaper artifacts.
Simple answer... Your assumptions are incorrect (unless Bioware is actively engaged in a campaign of disinformation).
Please see the thread 10 Things Fans Must Know from the Mass Effect Comics and Novels posted by Chris Priestly, then please follow the link in Chris' opening post to the NEWSarama.com article of the same name. Please pay particular attention to page 8 and page 1.

(SPOILERS AHEAD!!!)
For all who are stating you would spare TheSmokingIllusive Man **IF** he hasn't been indoctrinated, fare warning, it's canon. TIM has been (at least partially) indoctrinated. It''s revealed in the first issue of Mass Effect Evolution how this happened. I know... Metagaming. This is true. It is metagaming, but if you played Mass Effect 1, it can actually be deduced (or at least surmised) that TIM had been indoctrinated. All you have to do is look at his eyes. Saren's eyes were very similar. Many of the cut scenes featuring TIM focus on those eyes, as if the Devs were attempting to draw your attention to the fact that something wasn't quite kosher.
You are jumping to conclusions.
Nrama: Of course it looks like the Illusive Man "got burned" during the First Contact War (as seen in Mass Effect: Evolution[/b]) and maybe doesn't even realize it yet.
Walters: Yeah but even that is kind of open as to exactly what happened there. Obviously, Mass Effect 3 will reveal all; that's the point of Mass Effect 3, we tie up a lot of those loose ends. But I think it's safe to say The Illusive Man is still very much "himself" throughout the course of what people have been playing. We wouldn't ever want you to feel like "oh this guy I worked for was really an enemy all along." But that doesn't mean there weren't influences in his life.

But seriously though; it's deliciously hypocritical for these so called 'paragons' who generally love and respect the law are going summarily execute TIM without trial. Isn't that a bit of a renegade thing to do? Oh, how ideals do crumble!

It's never a good idea to spare your enemies.
Unless doing so effectively emasculates them.
Like Julius Caesar did to his opponents in the civil war.
...granted many of them later got together and stabbed him a few dozen times, but that didn't necessarily have to happen. Accepting their public capitulation was extremely useful in the short and medium term.

TIM is not used to a woman taking charge.

They first need to reconcile with the fact that their Shepards work for a secret police force that lets it's agents do things like blow up a refinery and kill 500 people just because they felt like it.
