You can never "download" an Xbox game, unless you purchase it through Live Marketplace. New triple-A releases like Dragon Age never appear there. If somebody is talking about "downloading" for Xbox, they are talking about stealing.

I thought consoles don't have piracy?

Without getting to deep into the logistics, the answer is _ you can pirate console games. Playing them is more difficult because MS will ban you if they know that you have or if you've modded your Xbox to play them.
Best to just stay off the subject of piracy all together though.
To answer your first question: since you can't get the 360 version right now, I suggest getting the one you would prefer on the actual release date.
