Debatable, but probably irrelevant. Legal can be very creative in how they construe things and events.
This wouldn't be half as wrong as what Hasbro is dong right now
Very, very irrelevant
but Mane6 just doesn't have any kind of legal firepower.
Probably the most RELEVANT statement
Also, with no way whatsoever to confirm whether Mane6 posted it on TPB instead of it being another leak, the C&D wouldn't be violated.
Debatable. They could still charge or sue what's left of Mane6 if something like this happenned, and they are a shrimp against a whale here.
If they went forward with your idea, what happens is:
-They waste more time and money
-Possibility of legal action against them
-Personal reputation scarred forever
Or they could cut their losses and just let the matter go.
It's a lose-lose, I know. But one "lose" is far less destructive than the other.

So pretty much this is a catch 22. They can;t not show bronies or they get called for ignoring them. They can't show bronies at cons having a good time, you know, like what you would want in an advertisement, or they get accused of doing worse.
I'm not a defender of corporations here, but that seems goddamn ridiculous. What would you have them do? Show a bunch of office workers crouched in front of the computer to hide the MLP youtube vids on their monitors?
That's a false dichotomy right there.
Also, I didn't say they shouldn't ever show a cosplaying brony ever. I meant that it's probably an indicator that Hasbro doesn't get the fandom as a whole.

Spring-"That could've been us."
Shadow-"Shame, but lets worry about us when our story's actually, you know, written."
Spring-"Typed."

If Hasbro ignores us they are ignoring revenue, and a lot of people are saying that they won't buy Hasbro products anymore, a little harsh, but the recent fan-work attacks keep happening, this won't go well for them.
If they start to attack FoE and side fics...

They will suffer the consecuences

You know what's worse about the Fighting is Magic issue? Out of all fan content, this one doesn't stray from what's acceptable in universe at all. I mean, look at Canterlot Wedding or the freaking comics. They could have just given them license to keep going. Hell, they could have even forced Mane6 to sell it for $5 if they didn't want to get disbanded and get the most insanely high royalties in the history of mankind. Sheesh, I don't know what would work or not, but anything would be better than THIS.
It'd be A LOT easier to close them down, and more in line with their target audience.

I'd assume as long as FoE doesn't get too much publicity, they are fine. But don't hold me to that.

You're telling me this as if I didn't know.
I know WHAT Hasbro is thinking. It doesn't make it any less retarded. There's no excuse for not having shutting it down early. Don't even try "they didn't know about it until EVO", that is BS. Even the staff was excited about it.

FoE is only really known in the brony community and to some in the Fallout community so it doesn't have the publicity that FiM got thanks to EVO.

That's not entirely irrelevant, at least if the mane6 are US based, the fighting game is technically a parody of the official show. Since they aren';t tryign to monetize it either it should fall under fair use. But i'm no expert in Copyright.

that is a problem and there should be some fund started to support them because i Do Believe that Hasbro Is Reaching into grounds that Are Clearly Defined and Established as Protected Forms of the 1st Ammendment here in the states at least, Again only applies if the Mane6 are state based (which i assume they are but i don't know for sure) SO they Should and Probably do have a legal loophole around the CDO i'm gathering they recieved today.

There would have to be solid proof they're responsible. If another Leak happened it could just be someone got their files hacked by someone and the game was posted unofficially. Sure Hasbro could try to retaliate against them but with no hard evidence that the Mane6 released the game, which if they did i'm sure it wouldn't be surprisingly difficult to get after all anominity on the net doesn't really exist, But Hasbro would have to find reason to believe it was them and legitimate proof acquired via warrant that it was them to take legal action. But Yes there is more to lose than gain.
There are legalities that should and could protect the mane6 and Fighting is magic alongside other fan made content through the fair use laws and parody laws. There are plenty of things Legally Amiss with what hasbor has been doing as of late.

I say let the fans bring it. Let's Take the revenue we would be generating and dump into some lawyers to Defend Parody and Fair Use against hasbro.

I want to know what was up with Prominence and the other guy leaving the team recently.
If I had to bet on it I'd say letting it go and cutting their losses. Based on everything seen and heard about Mane6, there was no reason to suspect significant internal tension.

I highly doubt EQD's gonna go down, as if it was, I'd think it would've gone down before even Fighting is Magic.
Why would they go after EQD first? They may be larger, but they are a news and content relayer, they don't make content the way Mane6 did.
