Your position is a solid one for a commanding officer, but don't make it out to be anything more than technicality. Tali and Shepard are flawed people.
Besides, they're both dead anyway either way. Might as well enjoy themselves before the end comes.
Albeit another argument that I haven't seen brought up is this:
Why do they need to do it right before the Suicide Mission? Why not do it a few days before instead of a few hours?
The answer is dramatic effect, but none-the-less.
What good reasons are there to romance Tali?

They made love before the omega 4 relay, there is nothing that says to us that they actually are having sex after that. Of course they will have is a game but I´m waiting to see how the relationship evolves in ME3

I'd be perfectly fine making out with a helmet. It might be sharp and covered with germs and possibly blood from battles before, but it's about the same as kissing Jack wearing a sharp helmet. Which is a scary thought in it's own right.

what if the mission ended up calling for tali to do some hacking or whatever and she had gotten sick from shepard so she was unable, it would have caused the mission to be a failure and gotten everyone killed.

The other quarians that are in the game use the nerve stimulator systems, it doesn´t make sense that Tali is special enough to be able to have sex with an alien and not only survive but come out with a minor fever. Quarians even get sick when linking suits among themselves!, if bioware were fair Tali should just have died, and for those willing to date a quarian, they should be able to deal with the no having sex issue.

That would have been fun, you can romance Tali but if you have sex she's automaticly killed on the suicide mission. I wonder what the reactions would have been then.
Personally I think it would have improved the story

there kinda is...humans mouths are filthy. hence why its treated so seriously when a human bites another and breaks the skin at a hospital? they flush the wound with so much medication its crazy.
the fact that she got sick from making a minor mistake during suit repair earlier in the game.
the fact that quarians get sick for weeks when linking suits, i assume they'd take some precautionary medication for that as well.
the fact they'd risk her LIFE, or cause a mission critical sickness in their tech expert before a "suicide mission" is beyond stupid and a leader like shepard wouldnt do that, and tali well at least her me1 self wouldnt be stupid enough to risk it either.
so yeah. its is kinda lore breaking, though i dont expect you to admit it considering your sig, not bias at all i assume?
