Re: OP

Because that's where his defense attorney, Zulu, lives.

Because when you're getting tried for war crimes, you're put on trial in your own country/planet. Since The Batarians are not a Citadel race, this doesn't concern the Council (as long as Earth takes action against Shepard.)

You're forgetting that Earth is only Shepard's home planet for one of his/her three Background histories - going by that logic, then the other Shepards who aren't an Earthborn should then be tried on Mindoir or in space on Arcturus Station.

Shepard is human. Earth is the homeworld of humanity. Earth is Shepard's homeworld as a natural consequence of biology, and (s)he is inextricably linked to it. As a human you belong to Earth, and Earth belongs to you.

Which goes against every known information and Codex entry given about the Alliance and human expansion in the galaxy that has been presented in the ME games and other ME media so far (as many others have pointed out much better than me).... <_<

Long story short? BioWare wanted ME3 to begin with a big freaken BOOM to the gut, hence Earth getting Reaper-Ravaged to the 9th Degree and then some.

It does no such thing. Humans evolved on Earth. As long as Shepard is human, Shepard is linked to Earth. Maybe not from his own perspective, but batarians don't care whether Shepard was born on Earth or a space station. In their eyes, Shepard is human and humans come from Earth. And biologically, as a human, Shepard belongs to Earth. His species evolved there. Earth is his ancestral homeworld, no matter where he was actually born.

Well, I guess they could have had Shepard on a space station for the trial, learning about the attack secondhand on television. That would be much better than a thrilling escape sequence where he teams up with Anderson to fight husks while a three-mile-long Reaper looms above him and destroys everything in the area.
