with the problem of when talking or listening to someone sometimes
there's either no sound (speach wise) or it get's cut off, back on PS1
or PS2 you'd take the game back to the shop and either 1. exchange it
for a new copy or 2. get a refund if you wheren't that keen on it, but
with the PS3 games get updates, looking at Assassins Creed that had a
problem the devs released a patch and all was well, and the game didn't
install anything so the fault was on the disc and the patch fixed it,
so what I think i'm asking is are patchs the future and returning a
faulty disc no longer needed?

Dont think you have a faulty disc. Others are experiencing the same with audio stuttering and will most probarly fixed in a later patch. Bioware will release DLC for over 2years for this game so i doubt they will not fix small or bigger issues.
