We'll just have to wait and see whether they were always there, or whether they appear at the trial and then escape to the ship. I'd imagine Bioware would want to introduce them (and Vega) pretty early, so new players will know who they're dealing with.
For all we know, they were overseeing the Alliance's renovations to the Normandy. Who knows?

One thing I do hope, is that they are introduced differently, even in different places, perhaps. Even though neither of them are my favourite characters, I was extremely disappointed in how they were clones for one another in Mass Effect 2.

Totally agree - they're such different personalities, why should they be mirror images of each other after you choose one over the other?

Winning them over shouldn't be a problem, not after watching the Reapers land, blowing everything to bits and killing millions, instantly showing Shepard was right all along. And blowing up a relay and killing 300.000 Batarians will pale in comparison to what the Reapers are doing so it might not even be mentioned any more after the trial. Perhaps Ashley/Kaidan will ask about what happened there and why but I doubt they'll condemn Shepard for it. There really wasn't any other way. If they still don't believe Shepard, I wouldn't want them on my ship anyway...

Since we saw Ashley in the demo I assume she'll be replaced by Kaidan in that scene. So if the VS is not part of the trial, Kaidan / Ashley will welcome you on board of the Normandy when picking you up.

If so, I can live with that. But it looks as if Shepard is still in charge in ME3, so I don't fear that. Ashley is still below in the command chain (Alliance) and less experienced Spectre. Kaidan may be higher in rank now (? to be verified ?) but also still less experienced as Spectre. So Shepard will be the one in charge.

Then when s/he knows about the reaper invasion he takes the Normandy to rescue Anderson and Shepard. When they pick up Shepard, the VS gives the command of the Normandy to Shepard (the VS will remain as XO).

Huh? Kaidan is the one for s/s with male Shep and he's an obvious choice for femShep. Besides, I don't recall any urns on the Normandy crash site...
