Considering you recieved and opened it, asking for a refund from Treehouse is not proper at that point. If it was unopened and you sent it back, fine but to ask for a refund simply because your not happy with the products paint job after the fact, especially when they did not produce it is not cool in my opinion. Some things you just have too accept.
Morally, I think it's the seller's responsibility: they were paid for sub-standard goods after all; whether or not they produced it is immaterial in my view. Legally, I'm not sure: if they had a presence in this country they would be legally obliged to sort it out, but I'm not at all clear what's the situation where either US law or imported goods are concerned.
But if nothing else, it's bad PR if they're made aware that they've been selling sub-standard goods and done nothing to rectify the situation.
However, I'm getting a bit ahead of myself since I don't even know their stance on the issue: I haven't contacted them about it yet.
