Ok, so while on our way to get some burgers, somehow me and my boyfriend's conversation turned to me making and selling N7 Hoodies. I told him that doing such a thing probably wasn't legal, seeing as BioWare makes and sells their own N7 Hoodies, so such an act could be considered counterfiting merchindise. He said that people were already able to make and sell things like N7 patches and that they haven't met the bad end of a lawsuit, but I pointed out that BioWare doesn't sell patches so they can't get in trouble for making counterfit merchandise. (now I know that BioWare does make and sell their own patches.)
So, what's the verdict here? Can I get in legal trouble for making and selling N7 Hoodies, or am I fine since it's a fan creation? I'm pretty certain that making them is fine, but selling them is a big no-no.

I mean artists get commissioned to draw fan art, but I don't see anyone getting sued for doing that.

Fan art is a different ballgame from hoodies I'd imagine though.

I dont know what it is in the states. But in AU as long as the image is 30% different your fine legally.
