That we still haven't seen a GOTY edition of ME2 for PC/360 with the unreleased preorder bonuses, probably long after the exclusivity contract with the retailer expired, means people will be more likely to do the preorder.
It's about cash. The game industry exists to make a profit. (Don't blame the game devs who see little of this $$.)

They did in the case of Arkham City.....Mass Effect 3 is a billion times better. An exclusivity on the heavy content like GameStop's for just one week will render huge profits as long as fans aren't aware it will be placed on retail until the last second.

I think my problem with this stuff is that it can be fairly cool (the M-490 Blackstorm, for example), which is meant to encourage people to purchase from that vendor, but long after that becomes irrelevant it never becomes purchasable DLC, as was the case with the Fallout: New Vegas preorder items (which I purchased a couple of months ago, IIRC - by then, most people who were going to had already played the game, and it was long enough that I think people who had the preorder bonuses really had nothing to complain about).

FNV's were practically the last DLC released, including GS's.
As for "in perpetuity" that would all depend on the contract language the two parties work out. it's possible, but there's some examples where that's not the case for other content.

The Argus Rifle from bestbuy certainly seems to resemble the Falcon, though we probably have to wait for the game to ship to see the differences between them in action.
