It was the art done by Patryk Olejniczak, who was given a job at Bioware. Yeah, Shep looks a bit young, but it's still a good piece of art. Either way it is by a fan who was employed while he was employed, and is thus owned by Bioware. It is possible they could use it. The ManShep one is far better than the previous official cover, though.

Too bad the image is so small and low-res. The resolution is too small to fit on my desktop as wallpaper.

Not really, it doesn't look like it's his work.
His tones, his lighting, his weird way of drawing faces. He just tried with the proportions and geometry more, so his vibe is a little lost. I think it's Patryk.
