I will not spoil it but this greatly disappoints me because he is the only reason I sympathized with synthetic life for believing they have personalities and even sort of souls

The only way the spoiler scenario could even happen is based entirely on who you sided with in the war. That said, Legion still dies no matter what after the Rannoch mission.

I don't have the leaked script on me, but from what I've read and heard was that there were two or three different scenarios for Legion, all of which come to the same conclusion. Tali's is only one of them, and the player would have to make a major decision beforehand for it to happen.
