It all depends on whether or not her A.I. black box could be disguised as something else.

Turn off the fans and it's an industrial sized grill!

the way I see it shepard told Admiral Anderson and Admiral Hackett and they used the influence/authority to keep the alliance away from interfering with EDI. Also if you play Arrival you will see chakwas and hackett talking and you also see edi there as well, so you know that hackett saw edi.

Well, Alliance was experimenting with AI on Luna and who knows where else. Why wouldn't they keep her?

Removing EDI from the ship before surrendering Normandy to the Alliance would be a smart move for Shep though. Actually, not giving the Normandy to them would be even smarter but I guess Shep/Hackett/Anderson were confident no harm would be done.

They should have destroyed her. The Alliance is a Council race, and an AI is against Citadel sapce regulations.
It doesn't matter if the intentions of that AI are good or evil or whatever.

The Alliance has experimented with AI's before.

why wouldn't they have kept her, an AI that is loyal and seemingly contained....they've dabbled in AI research before....

I think it is more of the case of what is going to be done a bought an AI that already exists. The law seems to cover only creating and researching AIs not ones that already active. Simply destroying her because she exists may be a bit too much on the slippery slop for some members of the System Alliance.

Why wouldn't they? Besides other reasons like it being illegal and all. Its technically illegal but not defacto.

actually...many reasons

-Killing an AI might still be frowned upon
-she possesses anti-reaper tech....which is ridiculously useful
-how do you flush an AI that advanced?
-she is an ally....why risk to lose her
-her body is sexxxxxxxxxxy

That period is not actually in the game, but my Shepard would have stole her AI core instead of letting Alliance military ruin her, assuming Joker doesn't do it first. :)

The Normandy is serious spec ops, maybe even black ops. I doubt more than a couple dozen people outside of her crew know all of her secrets. If I were Alliance brass, I'd send all the best parts to separate groups for analysis, and EDI is probably the most closely guarded secret of all.

I can see the convo now..
Alliance officer "are you aware that the system is totally infiltrated by an ai?"
Shepard "yes, and she likes the site of humans on there knees, I would suggest you not attempt to cut the blue wire"
Alliance officer "illegal tech is illegal tech..we have to..."
Edi "initiating purge, opening airlocks, Shepard, prepare for collector purge protocols, hold on to something"
Alliance officer "nevermind".

How hard would be to pretend to be a VI exactly?

Not hard at all for an advanced AI.  She can freaking hack nearby ships and make the airlocks open, all while fireing weapons at them with perfect accuracy, and running all functions necessary to flying the ship in a firefight.  My guess is that acting like a VI would be fairly easy for her, all she has to do is pretend to be "Dumb."

As far as the aliance was concerned, it's a VI on the Luna base, it's only hinted at being AI when Shepard destroys it and recieves the binary message through his/her helmet comm which translates to "HELP"

Let's see, the alliance has Sidon, they have Eliza out on Jump Zero, why wouldn't they keep EDI. Seems to me they are perfectly fine with illegal AI research and implementation

Wait now I remember little known canon lore. The Alliance offically does have a stable AI. I hope I get to meet it. Reminds of Braniac
