The game package should better be inside a larger protective crate to protect it from weather conditions and collisions.
And the crate should better have a parachute attached or else the game will hit the ground so forcefully thanks to the accelaration law of physics,that the game's package including the dvd will break to a thousand pieces when it hits the ground.

Not sure about high altitute drops, but one game was delivered to me in postal box, resembling meatball. Wet meatball. Game case was bulged, twisted and warped, punctured with sealing in several places, paper cover and inside paperwork were wet too (manual and artbook had pages "glued" together). Ironically enough, disks were Ok, and AFAIK is Ok still (I give that game later to one person, it was about 2 years ago). Had some problems with CD-key printed inside, though. So unless some eagle rams that baloon or some hunter shot box, I thing it should be Ok.

But remember regarding the falling games,that the physics law says that the more time a thing is falling,the faster its falling speed gets,and the faster the speed,the more the impact force that it will hit the ground with.

Why retailer? It was postal fault. Plus, they spent so much time on delivery, so all time limits for any form of exchange were expired.

Simple case (DVD-box) with minimal or no paper whatsoever will fall normally. Dropped some of them right from 5th floor to (not on!) some lazy dudes unwilling to climb up. Image IPB Mostly promo materials, like Cold Steel disks and similar "free" stuff. Box weren't even open on touchdown.
When I dropped heavier boxes (with gamesImage IPB), they usually were opened on touchdown (if sealant film was bad), some goods inside were popped out (if mounts were bad), but disks were fine.
Not that I dropped thousands of them, around dozen or so.

Addendum - no tarmac, tile or concrete around. Grass, snow, bushes, mud. that sort of thing. Image IPB

Not sure about ME3 case behavior when falling from high alltitudes - even knowing weight and terminal velocity it will be difficult to make proper calculations. And I'm not willing to do them anyway. Send this to Mythbusters maybe?Image IPB

Not really... you're forgetting about air friction. A tiny pin has a small terminal velocity, it probably makes no difference whether it is dropped from the 1st or the 5th floor.

Actually since the atmosphere gets more dense the closer you get to the ground, I would expect an object dropped from the higher atmoshpere to eventually slow down instead of accelerating.

I actually genuinely like this, but then I love guerilla marketing.

Sure, there could be a whole host of problems with it. But it's quirky and it encourages excitement among fans. It also might net them coverage on (inter)national news broadcasts.
