Kinect Notification shouldn't be popping up

Sure it has voice features but I shouldn't see the "Feeling tired or sore? Take a break." that message should only be on the Kinect games with body movement. Every single hour that I am playing either the single player or multiplayer (which has no kinect features) parts of the demo I see it. I am hoping it doesn't do that in the full game.
There is another game that had only voice kinect features and never had that notification so I don't see why ME3 has them.

Halo CEA doesn't have kinect funcionality on the disc, it's downloaded seperatly.
And If memory serves me right, you do get the notifications after you download it.

Sorry to bring this thread back but this really really bugs me (and I just found this out).
A friend of mine teste Halo Anniversary with Kinect for this (because I asked him to) and he said even after 3 hours of playing and yelling "Grenade, Reload..." no message.
So why is it there for Mass Effect 3? Microsoft could at least implement the option to disable it when agreeing to forfit any suing rights or whatever.
If this keeps on popping up during Single Player I will not be using Kinect and return it (since I only bought it for ME3).
