I'm pretty sure it's day one. Since the files were extracted from the demo, he's probably on-disc, locked content.

I think this is real, in the Art of Mass Effect Universe they show a prothean model in the Mass Effect 3 section.

Also, the protheans were an empire, not a single species (which is likely a retcon), but I also would have greatly preferred the human cthulhus.
