The whole 'cheating' angle is so overblown, because in most cases Shepard isn't actually guilty of infidelity. He was dead for two years and death has a funny way of bringing an end to relationships. Realistically all of the potential ME1 LIs should have moved on during that two year period. But whether or not the ME1 LIs eventually dated other people, they all make it clear on the reunion that they aren't interested in picking up where things left off. Liara is the friendliest of the three and even kisses Shepard, but still makes it clear that she isn't interested in picking up where you left off at the moment. In short, Shepard is single in Mass Effect 2. And a single person can't 'cheat.'
That isn't to say that one or more of the ME1 LIs shouldn't be jealous, as people do experience jealousy for all sorts of irrational reasons. I just object to Shepard romancing one of the ME2 LIs being officially defined as 'cheating,' when it clearly wasn't.
It is possible for Shepard to be unfaithful in ME2, but in order to do that Shepard would have to romance one of the ME2 LIs, and then after the suicide mission without breaking up with the ME2 LI, sleep with Liara during LotSB. In that scenario Shepard has cheated on his or her current girlfriend or boyfriend with an old flame. The irony is that this scenario probably won't even be recognized in ME3 as cheating by a ME2 LI.
On the brightside from what I've seen of people posting about the script leaks (not having read them myself), it seems that any confrontations over supposed infidelity in ME2 are easily resolved. While some people have criticized this for being an example of decisions not having real consequences, I'm happy with it, as even defining the ME2 romances as 'cheating' was a mistake in the first place.
As for Kai Leng...
I'd be against a scripted death of your LI at the hands of Kai Leng, but it would be cool if that was one possible conclusion to the romance arc.
