You're obviously aware that there is a Prothean squadmate by now. Knowing his name doesn't spoil anything for you. It tells you nothing about his backstory, nothing about his personality, nothing about what he says or does. It's not even 100% confirmed that Javik is his name.

Unless his name was "Unfrozen Revenger Guy 5000."

Also, no one going to get their ass "thrown in jail." The NDA violation (which, from the sound of it, there is none) would be a civil matter. And as long as the guy gets a good lawyer, he can show that no real damages were done to Bioware.

The fact that you had to rush onto the forum to point Bioware to this makes me wonder what you're expecting. A pat on the head and their eternal thanks?

In doing this, you've done little more than alert the rest of us about the sale. You're actually helping them reach more potential customers.

 *GASP* It's a trap! He's the seller!

Bioware would be stupid to even pursure this,  its a week from launch and the PR backlash from this would make the From Ashes fiasco look trivial.

There is a reason why the RIAA/MPAA are viewed as the most dispicable beings in the history of the world.

Why are you so mad by what I post?

You bump an old thread with recycled points from other posters.. Interesting concept.

Bioware could shoot a kitten on live television and we'd still be here in a week talking about how much we loved ME3.

Not mad, my friend. Simply seeking to educate what I perceived as ignorance.

More like there would be 1000+ threads on bioware shooting a kitten.  We all still buy their products however!

Except 60% of the threads here are about people complaining.

You're actually right on that point. The forums are the vocal minority of players. I've been (gleefully) playing the series since it started and never ventured here. I'm only here now because it gives me a platform to vent my anticipation of the game.

Most players are content to sit back on their couches, loving the game and never needing to say anything on a forum.

If they were a fan they would share the experience. Obviously they have few/no friends so want to make a buck. More power to them

80 copies? I'm pretty sure BioWare didn't release 80 copies of ME3 into space......Not just 80 In the USA, I don't think they released 80 copies worldwide......

Allow me to address some of your points:

At the time I posted this it was assumed that the seller did in fact sign an NDA. It was also confirmed that in the NDA it was stated that you could not, under any circumstances, sell your copy of the game.

Thus making it a larger legal issue than you make it out to be.

I posted it in hopes that the listing would be removed. I don't like scalping. Signs point to it coming back to harm the average consumer in a number of ways.  There is also a high probability that a copy being circulated without regulation will end up ripped and put on the internet. I don't know about you but I'm tired of all the leaks. I want something to look forward to.

Final point, I think you're joking but I'm not the seller. If you look closer the seller's ebay ID is his name. I wouldn't be so foolish as to draw attention to myself in this way. I am obviously a big fan of the game and would rather be playing it right now than selling it.

I feel uncomfortable responding to these old claims because I addressed them yesterday. It's easy to quote something I said during a past discussion and bring out of context. But it's harder for me to articulate my meaning when the circumstances have changed since the time I first posted.

Sorry but its not a "larger legal issue" than the guy was talking about, he's right.  It's a 100% civil issue,  criminally speaking the seller is protected by the first sale doctrine.

For the civil issue, Bioware would be stupid to persue it.  The Backlash of suing a customer would far outweight any benefit  you could possibly get from doing it.

Very much this, civil rights would jump all over it, those gamers you think are oh so nice and sensible would jump all over it, it would not matter whether they are right or wrong, it would be an excuse to stick it to the man, and they WILL use that excuse to it's fullest potential.

Really mate fenris is right its not that big of an issue. To many you seem like a kid moaning about the kid down the street who wouldn't let you play with him. Just enjoy your life and don't waste it on stupid things like a copy being sold early.
