Also, no one going to get their ass "thrown in jail." The NDA violation (which, from the sound of it, there is none) would be a civil matter. And as long as the guy gets a good lawyer, he can show that no real damages were done to Bioware.
The fact that you had to rush onto the forum to point Bioware to this makes me wonder what you're expecting. A pat on the head and their eternal thanks?
In doing this, you've done little more than alert the rest of us about the sale. You're actually helping them reach more potential customers.

Allow me to address some of your points:
At the time I posted this it was assumed that the seller did in fact sign an NDA. It was also confirmed that in the NDA it was stated that you could not, under any circumstances, sell your copy of the game.
Thus making it a larger legal issue than you make it out to be.
I posted it in hopes that the listing would be removed. I don't like scalping. Signs point to it coming back to harm the average consumer in a number of ways. There is also a high probability that a copy being circulated without regulation will end up ripped and put on the internet. I don't know about you but I'm tired of all the leaks. I want something to look forward to.
Final point, I think you're joking but I'm not the seller. If you look closer the seller's ebay ID is his name. I wouldn't be so foolish as to draw attention to myself in this way. I am obviously a big fan of the game and would rather be playing it right now than selling it.
I feel uncomfortable responding to these old claims because I addressed them yesterday. It's easy to quote something I said during a past discussion and bring out of context. But it's harder for me to articulate my meaning when the circumstances have changed since the time I first posted.
