It would be in their best interest to respond to it somehow...
I'm not too sure of that. As of right now, the game has great critical reviews, and has only been out for a week. Many of the big review sites, such as IGN are posting stories about how rediculous fan complaints are.
If they come out and say there is a problem and they have to fix it, which they doubltessly eventually will, that is likely to have some kind of negative impact on sales in the short term.
Yes, but Business 101 is to build brand loyalty. Sure, a hit in short term could hurt, but alienating a large portion of your consumer base can make a company go belly up. There are plenty of case studies where companies that announced a cautionary recall wound up being praised later on rather than wait until they were losing tons of money and then say "Sorry, our bad". Look at Pierre Mineral Water and contrast that with the Ford Tempo.
It's actually a really interesting conundrum. I actually agree with you for a company that is it's own corporate entity, but in this case you have a company which is a creative entity which is under the wing of a larger corporation with a bottom line and financial expectations. EA expect that Mass Effect 3 sells big, and likely would not want Bioware to make creative statements that could harm it's bottom line until there is a clear plan.
What is clear is that Bioware in the long run does respond to criticism. They have been pretty upfront about some of the issues with Dragon Age 2, without ever calling it a disaster, and responded to some of the major complaints in the DLC. They also responded to the controversy over the book by promising rewrites in future editions.
It's very likely that, in the long-term, they assume the amount of people they lose if they respond ot controvery in a month post-release, is less than the amount it would lose if they admitted to flaws out the gate. This is especially true when the flaws can be debated, even if the people debating it are in the minority.
I would be really impressed if they responded quickly, as they doubtlessly expected confusion and interest, but not this level of acid. It's dissapointing that they likely won't.
