Do the items from Legacy and MotA scale with level.  At what point in DA2 is it best to play legacy and MotA?

Legacy and MoTA items are scaled to your current lvl when accuired, but do not scale further after that.

As to when to play it, it's probably best to do it in late act2 or early act3. If you do it too early, some of the items will quickly become obsolete, and if you do it too late, you won't get much use out of them.
As a side note, items in Legacy have a scale cap at lvl.25 (save for the Hawke's Key, wich doesn't have one), meaning they will have max stats once your character reaches lvl.25. So, if you want max stat Legacy items, that would be the ideal time to start Legacy.
MoTA items do not have a scale cap, and will always scale to your current lvl, when accuired.

Go get the mod over at the Nexus to make them all improve with level up, and get rid of that lev 25 cap. Now Legacy is a go anytime after you encounter your first Carta and MoTA anytime after becoming champion - just for the story to make sense as to why you are there.

That would be the mods to get them to improve with level up Also you might want the one for Grandma Amells's ring if your Hawke is not a mage - that is special for Bethany and, needs it's own file.
