Not even. My GameStop is way too small to afford a leak. They're pretty good about not breaking Street. Just the sheer amount of money one has to pay is enough to make me scratch my head.

You have to do one of two things:
1) Someone has to bring them a RECEIPT, showing a purchase, usually WITH the product, itself. Not a picture of a receipt, but the actual paper receipt.
2) You have to give them a LOCAL store phone number (ie: Target...it's going to have to be a large chain store, too...not a mom and pop) that will confirm the item is in stock and available for purchase. They will sometimes send one of their own employees out to secret shop it, too.
The procedure, then, is for them to call their district manager to report it. The DM then calls their regional manager, who will, more often than not, approve (especially if there's a copy of a receipt) sales from that point. Sometimes just for that store, sometimes for all the stores in a district, sometimes for all the stores in the chain (and one of their "system alert" messages would be sent out).
Sometimes, if there's a widespread report from a credible news source (happend with the DSi, for example) that retailers have broken street, the DM's or Regionals will catch wind and then alert the stores they can sell. That's far more rare, though.
They're not going to allow themselves to lose massive sales from "their" customers because Walmart, en masse, broke street date.

It's probably a violation of the contract that Walmart has with EA...but if it's one isolated copy in one Walmart....EA's not going to pursue it. And even if they did, they'd only be able to "fine" them.
