If I kill him during the battle that's it?
 He's dead, and not just simply rendered a non-factor reserved to be revivied immediately when the battle ends so I can recruit him? I may have misread, but  what spoilers I've seen have indicated more strongly to the former.

And he's a random enconter unlocked after the first major story quest? What are the odds of encountering him?

Having just watched a streaming feed where someone recruited him into their party - from what I can tell, he goes down in the battle, but when you walk over to where he's lying after the battle ends, a cutscene plays and you have the option to revive him and question him, or kill him outright.

This is correct, and as far as I know the chance is 100%.
