That's clearly the same image, just one has been photoshopped a bit. This either means that Bioware did a c/p job, or whoever did the videos of grandpa is just trolling everyone.

this was at the end of C&C 4 it was the lastes scene ever to be part of the C&C franchise

How is it a troll? What is says is correct, and that wallpaper is on many, many different sites and the dates it was put up is long, long before now.

If anything this implicates Bioware, or the person that recorded the so-called Grandpa ending.

They should. An artist should be paid if their artwork is used by a corporation.  A coporation should be held accountable if they didn't buy the right to use it. If it was EA/BW on the reciving end, they would have mad lawyers going after the guilty party.

Do you anything about artistic copyright infringement?

It may be, I suppose, but that image is the #1 result for that search on Google it looks like it's been around for a while. The "leaked" image is also a distinctly separate piece. 

To assume it's a troll, you'd have to assume that (a) The leaked Mass Effect image has been doctored to be animated and different in other ways, and is not actually in the game, or ( The guys from 4chan somehow got the "original" winter space image to not only appear on many different websites, but be the first Google result, and, of course, create the piece of art in the first place. 

What's more likely is that someone from Bioware liked the look of the art and thought it would be fitting for Mass Effect, tracked down the original artist, payed the rights, and put their own rendition of it in the game.

It is almost the same. The spacing of the trees, the moons, and the color pallet are pretty much the same. Maybe not enough to take legal action but it certainly is lazy.
