Maybe... since all this situation encourages the use of "External Programs" such as Modio, which are against the Xbox Live Terms of Service... don't know but, maybe Microsoft has refused the patch... and considering the fact that it doesn't fix (all) the issues we have, more and more players will use such tools...

And that's only according to BioWare, not MS as far as I've seen. Have you seen MS announce that the patch was certified or advertise it in any way on LIVE?
