 I've heard that Kenneth is supposedly in custody and you can get him back via the spectre's office. However, I can't figure out how to do so, has anyone got him back?

There is a memo in the spectre office console about Engineer Kenneth, if he survived ME2 of course. There is an option to AUTHORIZE his pardon for events in ME2. Then later he shows up in your engineering bay.  I don't know when this memo shows up though I forgot that part.

For me it showed up after the mission on Sur'Kesh

After you find the Primarch, I believe.  Not sure if From Ashes influenced when it appeared or not.
