I contacted EA with the issue and they told me the following steps. So far so good. I'd like you to try them to see if this is the definite solution:
1) Clear your HDD's system cache
2) Sign out of Xbox Live
3) Change your clock to November 15, 2005
4) Restart your console. Live should update your clock now
5) Boot ME3 and download the 4 MB patch
6) You should be happy and DON'T have the problem now.

Curiously I still get the error on ME2 but not on ME3. BTW I have ME3 installed on my HDD and NOT ME2. So probably if you're still getting the error you should install your ME3

Sorry to necro this, but I never had this issue UNTIL I emptied my Xbox system cache. Hope that helps fix this.
