I think I read this before. Is this a bug and if so is there a patch? what can I do about this?
Javik/Prothean Bug? Cannot select as squadmate, is just a black picture...what can I do?

You can't take him to Palaven. That's all there is to it.
He even tells you he needs to rest after you pick him up.

Actually, he is locked for all missions until Palaven is done - I tried doing an N7 side mission before Palaven after picking him up and he was locked, only unlocks once the main story passes the Palaven checkpoint.

Yeah he's still recovering from stasis until Palaven's done.
