I'm not missing that EA is the publisher and this means it could know nothing about the game itself, should EA to team up again to check the whole code of a game produced by a subsidiary software house or go with a "grant me the code is ok 'cuz, after all, is up to you.." way ?

It's evidence that this kind of controls doesn't provide for an extensive playthrough test.
QA at EA certification must be sure that the game is all ok at the market level, this means storyline is ok as documentation evidence, menu, soundtrack, multiplayer ecc... Bioware have probably an internal certification process for the source code iteself, so, yes, for the code is Bioware last word. But for the gameplay and other marketing points it's EA last word. This means also that the bug itself can be achieved to EA Italy mistake, as the QA must had tested RTM discs just after the press.
For Microsoft, you're right also. Microsoft, as I already wrote, doesn't provide tests for game contents. It provides only stress tests and check for the program executable, so it will likely give no problems on the Xbox 360. Grissom Academy, in fact, cause a freeze of the XBOX for corruption generated by incorrect files over the discs, that it's likely not a test done by the MS certification process as it implies full playthrough tests.

And, last but not least, It's 23:52 and no word from Ryan about MS certification. This means that for today it's done, even if I got certifications at 2:30 AM on my WP apps.
