How did Legion die?  He had reestablished contact with the rest of the geth.  His programs should have been reintigrated into the consensus.

By the time Shepard got off Earth, Legion had been home for several months, more than enough time for him to upload all of his programs into a hub, which may not even have been necessary, considering.

And each geth platform can host any of the geth programs, so the ones that are in Legion by the time of the third game are likely not all the same ones that were present within that platform during the second game.

He was all geth.  All of his memories, everything that was him, should have been still alive within the rest of the geth.  Maybe the last few hours of his life would be unique and not uploaded, but it still doesn't make sense that they treat him like he's dead.
