I'm wondering if I can get a refund of my investment in the game based on I was not getting what they told me they were selling. My chocies didn't matter in the end, which they said they would and I did not get to take Earth back, I got to destroy galactic civilization.

I wouldn't be surprised if the 20 million word EULA has a clause preventing players from suing, but instead agreeing to "Binding Arbitration". And of course those places are always packed with people loyal to EA and found summarily find in favor of them.
No, I'm afraid the best thing to do is vote with your wallet.

I want them to change the ending, too, but I'm uncomfortable with the idea of "punishing" Bioware, because the rest of the game is so amazing. They make great games and will continue to make great games. Yeah, they made a big writing mistake, but they weren't deliberately trying to crush their fans. Who in their right mind would? Bracket you rage and join the more rational appeals to Bioware's better nature.

I think most people here are kidding, though there's is enough disappointment that it makes the idea of suing seem great. Like Qutayba said, the wallet or withdrawing your wallet is the way to go. I won't be preordering, and probaly wait til a new game is about £20 before I give Bioware another chance. Unless they make good and give us alternative, better endings.
