be a healthy, positive thing, rather than a spiteful one.

While it would be a nice gesture on EA's part, every company has a fund dedicated to social responsibility and charitable work. I know the company I work for spends, literally, hundreds of thousands of dollars, if not millions, a year on local charities that their locations are involved with. That's only counting local initiatives driven by small groups of employees. Charitable donations for the company, overall, in 2011 were somewhere between $25,000,000.00 - $30,000,000.00.
While EA doesn't even come close to us, in terms of size or profits, a $65,000 donation / tax write-off for a company of their size isn't really a big hit: they're still a Fortune 500 company, I think. That said, it would be great for Child's Play if Bioware/EA did match the contribution, regardless of whatever else happens.
However, the point of asking for a refund is not to give EA an awesome PR oppurtunity. It is to make a point, in one of the oldest ways a customer can, that the product or service provided does not function, or perform, as advertised and as a result we're owed our money back. Thousands of people requesting refunds for the same reason isn't something that can be ignored or dismissed by a corporation.
I've seen people lose their career over less: breaking the customer's trust is to be avoided at all cost.

It would certainly change the playing field, though I'm not sure it would be a one-sided improvement. I think it would help our side as well, showing everyone that EA respects our position.

Made a post in another thread asking what might happen if we all asked for a refund. I think, obviously, that the idea has some merit, but I'm only linking it here because its original thread seems to be getting buried fast.
I, for one, would gladly done the $79.99 refund into the Charity, to which I already donated. If only to make the point that I would rather give my money away than support a company that behaves in a manner that I don't like, or allow them to keep money for a product that doesn't perform to expectations.
Would anyone else be interested in giving this a go?
