If i recall correctly you can choose to let him live right?
It will change how much EMS letting him live/die?

not... really. You can kill all the Colonists or have them survive. And you can help them in ME2. Helping them will have them appear as War Assets in ME3, killing them ....not so much.

Pretty sure you're forced to kill the Thorian regardless. But you can choose to save the colonists as well as the Asari that the Thorian was given by Saren.
