Condition as to services
58(6) Unless otherwise expressly agreed in writing signed by the buyer, there shall be implied in every retail sale of services a condition, on the part of the seller, that the services sold shall be provided in a satisfactory manner.
Seller to provide record
58(9) Where a seller is required under this section to correct any defect or failure in any goods sold or services supplied by him, he shall, on each occasion give at the time of the correction, to the buyer a written record of all items and services that are used to correct the defect or failure at the time of the correction.
I am told these are legitimate legal grounds to subpoena you to a trial for breaching the Canadian Consumer Protection Act. You see if your screwing people over because you think a grey area offers plausible deniability.... turns out thats wrong if you apply tax to an item (ie: bioware points) it is classed as a part of the material goods class... which you guys know cause you need to class that for taxation but by classing it as a material good so you can tax it (and probably keep that tax) you bring your goods into the same laws as lets say a gas camping stove.
You see what you guys are doing with this is akin to a company selling bottled water and telling your customers to fook off when they complain that the bottle you sold them was infact filled with air not water.
Luckily I have family that got into law, from what they tell me if your in breach of the consumer protection act I wont have to pay a damn thing to get the trial rolling.

I suggest that you post that in the Mass Effect 3 Multiplayer forum since they obviously don't give a **** about this version of the game let alone read this section of the forum.

I don't think you understand what this is saying. These laws are for retail stores (EB Games, Future Shop, Best Buy, etc. Basically stores that buy products from developers and resell them). So unless you bought your copy of mass effect straight from bioware's office, you're **** out of luck bud.F4ll3N1 wrote...

In English:
58(6) - The cashier has to sell you the product in a friendly manner and not be sketchy as **** when selling the product. (you know how sketchy car salesmen are)
58(9) - A defect would be something along the lines of a scratched disc or null cd key. If this were to happen, a retailer store would gladly either give you your money back or exchange the product for an exact same copy.

Like I said If they are taxing the item it falls into this Act, those sections are just a section of a massive document outlining many forms of consumer based business this is from a section specific to retail goods which these are classed as. Also this notice the conflict in sub section (e).
Rights of cancellation
65(1) Except as provided in subsection 62(3), the right of a buyer to cancel an agreement under this Part is not affected by
(a) the delivery of the goods to him; or
(
© the partial consumption of the goods by him; or
(d) the accidental destruction of or damage to the goods; or
(e) the partial performance by the vendor of any services;
Defective goods or payment sent and goods not delivered is illegal in canada regardless of what "kind" of product it is. If the company has al icense to sell these items in canada elctronically or not and they are charging tax on these items they must be compliant wiith the Canadian Consumer Protection Act. It has nothing to do with understanding complicated wording (which I do) it has to do with right or wrong, you know the purpose of having laws in the first place.
If this got to trial they would loose 100% this is decietfull business and it is not tolerated here. And like I said this isnt a "Im suing them" thing I have nothing to do with it. It is my duty as a citizen to bring these transgressions to the authorities and then they handle it, I dont get paid and neither does our gov. We just make them behave like human beings instead of sociopathic gluttons.
Grey areas work both ways, you can use them to exploit a system or use them to prove the need to remove a line of exploitation in the system. If it is plausible to exploit a system it is plausible to prove that exploitation is not intended and damaging.... in this case it is easy to prove there are pages of forums with legit accounts and names attacked to them able to be subpoenad with testimonial proof that money was spent on the promise of goods and or services rendered and those services were not rendered, not hard to prove that is it?
Lawyers trick you into thinking you win court cases with fancy complicated loop holes and only they can do it, cases are won based on the interrpertation of the law and if you can prove a laws most basic function in society and that it fundamentaly conflicts with the actions of any form of business you have them cold.

About the workaround--after losing another 100k just last night (God, it must've been like a million by now), there is one VERY important thing that I want to stress. Besides not shutting down Mass Effect 3, you must also make sure that you do not hit OK on the failed purchase message! If you do, your credits will be lost. You must wait for the failed purchase, then disconnect right away after you see it--I always turn off my router, then turn it back on. You want to hit OK only on the message that says you've lost your connection, not the failed purchase message. Then you can open up Multiplayer after reconnecting to the EA servers in the main menu and you should receive your pack as normal.
This works every time for me as long as I don't hit OK on the failed purchase message.
Once again, that is not a solution. It's an aggravating and ****ty workaround.

Normally when a purchase fails on me I can exit game, come back, find my credits gone, but still get my stuff, I just don't get to see the pack open. This time I didn't get anything.

I already lost a lot of Credits and several Bioware Points to your bugged InGame Store, because it encountered an Error during the Purchase and then I just lost the Points and/or Credtis, BUT DID NOT receive any items. I double-checked that a few times by now.
The InGame Store worked flawlessly on my end during the Demo (more like Beta, duh) but it is getting worse after every patch and it reached it's maximum of "worse-ness" after Bioware released the MP DLC.
Means, for me, I will stop playing ME3 so far, until Bioware fixed this issue.

You guys need to really give it up, there is no refund plan of action, and just so you realize you arnt always losing your credits you are just getting items or upgrades. Just because you dont see the New notification every time you buy a pack doesnt mean you are losing your credits.
I am loosing credits sometimes. Proove me wrong. I don't need refund, but I want FIX.
