This means that a reasonable person, me, was not able to understand their puffery. I could not understand it as hyperbole. That it what defines it as potentially illegal.

Also, trust me, I had zero expectations for ME3. I honestly am amazed it's as good as it is.

 you are not confused by it they never ever stated that  that you choices will effect the ending they stated that it will effect the game NOT then outcome of the game endings they only actually stated  that if you dont have over certain amount you shep wont do as good or get enough war assets to help.

. so  your saying of confusion understand  is null and void  i didnt get confused on the endings  at all i knew what they ment by having played all 3 games first time i played m2 then i wanted to se what the differecew was and low and behold the game  did infact change to me..

All these arguments are moot to begin with, being that the only thing about video games that interests the FTC is sex and violence being marketed to kids.

And saying if an internet connection is needed stuff like that.
