Commander Shepard = Captain Kirk... Sure, he may have been an Admiral at one point, but he will always be CAPTAIN Kirk.

In the end shepard is working under hacket with his authority in gathering resources and how to go about it...along with working with the councils authority even when alenko gets to be a spectre shepard is still in authority over the operation under hackett. also being the first spectre gives shep weight along with the N7 designation. so yes kaiden outranks shep..but shep is the CO of the ship and again only accountable to hackett and the council.

Major Alenko does indeed outrank Shepard, by 3 ranks at least. I always found it strange that Kaidan and Ashley both get promoted rank after rank and Shepard is the eternal Lt. Commander... But I guess Shepard being an N7 elite operative and the Commander of the Normandy gives him the authority there, since Spectre status pretty much doesn't mean anything in that case with Kaidan getting Spectre authority too.
As for the other comment on Bailey... I never fully got that story. Apparently he got promoted for taking down the corrupt Executor Pallin from ME1, but from all I know Executor during the events of ME3 should be Chellick... or at least Chellick was head of C-Sec in ME2. So I didn't quite get that story myself BUT C-Sec has - as with every police IRL as well - a different rank structure than the military, in this case the Alliance Navy and the military's ranks are higher than any police rank.

At the start of ME1, Shepard is a Lt. Commander and the XO of the SSV Normandy. Alenko is a Staff Lieutenant and apparently the commander of the Marine Detachment on the Normandy (according the wiki's anyway - I never picked up on that). Williams is a Gunnery Chief, which puts her as an NCO under Alenko's direct command.
After Shepard becomes a Spectre, she is promoted to the Alliance rank of Staff Commander (which appears to be commonly abbreviated as simply 'Commander') and made the C.O. of the Normandy. Navigator Pressley becomes the X.O., though I'm not sure what actual military rank he is (obviously something below Lt. Commander though, otherwise he'd be the X.O at the start of ME1 and not Shepard). Alenko remains a Staff Lieutenant, and Williams a Gunnery Chief.
Commander Shepard is then M.I.A. presumed dead when the Normandy goes down at the start of ME2. Cerberus then revive her, and technically I guess that would change her status to AWOL since the Alliance is aware she's still alive. In the 2 years that Shepard was 'dead', Alenko had been promoted to Staff Commander (2 rank jump to the same rank as Shepard) or Williams to Operations Chief (1 rank jump to the most senior NCO rank).
Come ME3, Alenko is now a Major (1 rank promotion) or Williams is a Lt. Commander (4 rank jump, including making the jump from an NCO to an Officer). Shepard is re-instated (meaning she was technically discharged at one point I guess, probably because she was 'dead') as a Commander and given command of the Normandy. Since she's the C.O. of the Normandy, she will out-rank the higher ranked Alenko in matters relating to the command of the Normandy.
Bailey is C-SEC, not Alliance Military, meaning he will follow their rank structure. It's most likely based on a Turian Military Rank system, since the Turians were the driving force behind C-SEC's creation.

Shepard is likely a full Commander as of ME3, considering they specifically label Ashley as Lieutenant Commander, but not Shepard.

The most telling thing might be the officers uniform. There are three bars on his/her shoulder which is the same number Anderson has in ME1 when he is still a Captian. Admiral Hackett has four and Anderson's uniform before the war in ME3 looks much different then Shepard's but his war outfit has four bars showing he is an Admiral.
So it could be that Shepard is in fact a Captain now.

The rank system in the Alliance in wonky at best. An alliance major is the equivalent of captain rank, which means that Kaiden has a higher rank, however, it seems that, per Andersons orders, Shepard is commanding the Normandy, which means that Kaiden is under his command.

Even as a Commander Shepard has authority over those who out rank him since it is his ship. I think this is how it is even today unless the out ranking officer is part of thIne Captains chain of command.
In the case of Kaidan his rank might be equal to that of a Captains but he is removed from the naval command in the same way modern Marines are even though they are technically part of the Navy.

When Shepard is inducted as a Spectre, according to Admiral Hackett Shepard is, technically, still part of the Alliance military (though Captain Anderson claims otherwise). Therefore, Shepard should still be referred to as a Commander, even though Shepard is outside of the Alliance military's chain of command and answers directly to the Council.

As long as Shepard is the CO of the Normandy and Kaiden is stationed on the Normandy then no, he does not outrank Shepard in this case. Technically he is of higer rank (according to codex), but again as long as Kaiden is on the Normandy, Shepard calls the shots and he has to follow his/her orders.

Shepard calls ashley LC as in LT-commander Ahsley calls shepard commander and once befor the final show down she called me Captain i think durning the final mission shepard was promoted to captain
