Considering a class action law suit based on false advertisment

Ok I see a lot of people attacking the OP but nobody is actually talking about how this isn't a classic case of false advertisement. If you take a look at the statements made by developers then it seems to be a pretty clear cut case of it.

Seriously as upset I was at the end of the game, I don't think this is necessary. I think Bioware/EA are well aware that their fanbase is not pleased and I'm sure that to maintain their loyal fanbase they will release an Ending DLC.

I cant see them NOT doing it. The consequences would be too great IMO

In terms of legality, I can see Bioware getting out of it fairly easily.

Prosecution: You said that the outcome would be shaped by your actions in the game! This is not true!

Defense: Actually our clients allow you to make three choices at how the game ends.

Prosecution: Um... er... but that's just the end! But nothing you do before that counts!

Defense: Actually a lot of what you do will determine your effective military strength, which determines the options available to you at the end and what exactly the outcome consists of. If you don't do the right things, you could have everything go horribly wrong, so technically yes, the choices you make in the game do determine the ending.

Prosecution: ...

Judge: Court finds in favour of Bioware.

Is there any cases that actually made it to court specifically saying interviews do not fall under advertisement/ promotion of a product? Anyone? If not is is a legal gray area that needs cleaned up.

aw man i needed a good chuckle i think the court has real issues to worry abought instead of a video game


$210 million just in physical sales, not to mention dlc and ce editions.  Yeah.  It's totally tiny.  It needs to be more like $500 million amirite?


i believe the courts are more worried about things like murderers id theft major stuff like that

i can honestly see an episode of judge judy taking this mass effect 3 case and i can see her telling the guy grow up and then kick him out and fine him for waisting the courts time

For all five minutes that it was on the air, right? :lol:  Actually, IIRC, this episode was the first episode they aired, though oddly it wasn't the pilot. ABC kinda dropped the ball on that show...

You're wasting your time. EA has a legal team big enough to take on the entire United States combined, let alone just a few members from the Mass Effect community. The trilogy ended, you didn't like the ending. Big deal. It happens every year with just about every video game released. What's done is done. It's time to move on.

Okay, I didn't like the ending. At all. But a lawsuit? Really? Do youself a favor and go for a nice long walk, try to apreciate life, and realize that if ME3 were the worst game ever it has no real impact on your life.

Ok can we stop using this as an example of a frivilous lawsuit.  It gets brought up by every braindead moron who obviously didn't read anything about the case other than hurrr durrr coffee spilled.

But, if a company of any kind makes promises, and the product you recieve is the complete opposite .. is that not False advertisement?
If everyone says .. Oh its just a game, or Tv, whatever it may be and says nothing about it ... they do it again.
next, another company says .. hmmm that works to bolster sales.

Next thing you know everyone does it.

At some point, you have to draw a line and say NO, give us what you promised.


Exactly how to handle it, Im not sure. But I do think it needs to be brought out.

Stupid and more to the point negligent is serving a beverage meant for human consumption at temperatures that it cannot be consumed it.

NO.  Because thier oppion did not match yours, big deal.


BUT, lets say you love pickles.  You get that burger and there are no pickles on it. 

You were told it came with pickles, you wanted them, you paid for it, you expected it. 
Should you demand they give you your pickles?
