Actually verbal contracts are legally binding; the writing-down is only necessary because usually a handshake and a drink of Vodka is hard to prove in court. However, this "burden of proof" does not apply here since BioWare is not even trying to hide their false advertisement.
As for not admitting they had to change things: Why the hell not? I am sure most customers would understand that, contrarily to what you think we are not stupid.
