It might run into problems if Bioware declines delivery, what will the cake maker do with them then?

As long as the cupcakes are delivered straight from the maker to Bioware, I'd say yes. If they touch intermediate angry fan hands then no.

It's a different way to express dissatisfaction with the current ending(s?) of ME3. It's not harmful...unless they are diabetic or allergic to Red dye 40, etc. If Bioware disagrees they still get cupycakes to nom.
