Exactly. Whether they throw an "I promise" on top of that is irrelevant. If the box of the game says Mass Effect, I would hope the game disc actually contains a copy of Mass Effect. Basic principle.

Well by your logic they shouldn't have to tell anybody the game has been delayed, because they didn't say "I promise".

You could just show up at the store for the release date and hear "Oh, yeah, just found out the game won't be here for 6 more months. Sorry about that, we're confused too."

Or they could ship you the empty box and say they never promised to give you the game. The photo only showed the game BOX. If you paid $60 for the game BOX it's your own problem.
